Clarence H. Potts and Sarah E. Potts, hereinafter called the plaintiffs, filed their bill in the court below against the town of Purcellville, alleging that they were the owners of a tract of some 300 acres of land situate in Loudoun county, Virginia, through which ran, in a well-defined channel, a stream, popularly known as “Laurel Branch,” having its origin in springs on the eastern slope of the Blue Ridge Mountains to the west of their property; that the town of Purcellville had constructed dams across the two tributaries of the stream above their property; that it was thereby impounding a…
