PONDER, Justice.

This suit comes to us on a writ of cer-tiorari and review from the Court of Appeal, parish of Orleans, on the application of defendants and appellees.

The plaintiff alleges in his petition that Fenner & Beane, a commercial partnership, domiciled in the city of New Orleans, composed of Charles E. Fenner, John McCor-kle, and others whose names are unknown, are indebted unto him in the sum of $1,333.-33; that on November 29, 1925, the plaintiff opened a brokerage account with Fen-ner & Beane at their office in the city of New Orleans for the buying and selling of securities on the…
