ORDER

In light of the parties’ responses to the court’s December 20, 2007 order, we consider whether to vacate the Merit Systems Protection Board’s decision in Hoff v. Dep’t of Justice, MSPB Docket No. DA-3443-06-0248-1-1 and remand this petition for review for further proceedings.
