The distinguished Assistant Attorney General, representing the appellant in this proceeding, after the remandment of this cause to this court by the Supreme Court, has prepared a statement of the issues involved together with the law applicable and conclusions to be necessarily drawn, with which we are in full accord. Hence we quote and adopt as our opinion his excellent treatise on the questions, as follows:
