This matter comes before the Court on Defendant Dryvit’s demurrers and special pleas with respect to RML’s Cross-Claim. RML, the general contractor of the project known as Bay Point, filed a cross-claim against Dryvit consisting of seventeen different counts. RML further alleges that Bishop Wall Systems (“Bishop”), the supplier of Dryvit to Kemp Contracting, is the agent of Dryvit and therefore Dryvit is liable under a number of the seventeen counts as principal.
