In this case, which has been dismissed by stipulation of the parties, a question is made by counsel for the complainant as to whether the case is one in which a final record should be made by the clerk, and paid for by the complainant. The *308question involved is one upon which, so far ás I know, no reported judicial determination has hitherto been made in this district, although it has been informally discussed and considered on several occasions.
