Appeal from a judgment of the County Court of Ulster County (Bruhn, J.), rendered September 19, 2000, upon a verdict convicting defendant of the crime of driving while ability impaired by alcohol.

During the early morning hours of June 5, 1999 in the Town of New Paltz, Ulster County, a town police officer, Sergeant Joseph Snyder, observed defendant’s vehicle proceeding in an erratic manner by, inter alia, weaving to the right of the fog line and traveling beyond the edge of the paved highway.
