MEMORANDUM OPINION AND ORDER

Pro se plaintiff Myron Tereshchuk, a prisoner, brings a FOIA claim against the Bureau of Prisons (“BOP”), 5 U.S.C. § 552, alleging that he constructively exhausted his administrative remedies after BOP improperly withheld records sought in three separate requests. The Bureau of Prisons moved to dismiss the supplemental complaint or, alternatively, for summary judgment, arguing that Tereshchuk’s failure to exhaust his administrative remedies bars judicial review.
