This action was commenced in the Philadelphia County Court of Common Pleas with a complaint filed on April 29, 1977. The original defendant, Pilling Co., allegedly manufactured and sold to Philadelphia College of Ostéopathic Medicine — Barth Pavilion (Philadelphia College) a defective set of forceps which broke during a surgical procedure being performed on plaintiff by Dr. John W.
