This is an action to recover a statutory penalty for defendant’s refusal to issue a transfer at an intersection of its lines at Adams and Willoughby streets in the *120borough of Brooklyn. The plaintiff desiring to go from the borough of Manhattan, boarded a so-called Bergen street car at the Mew York end of the Brooklyn bridge. She paid her fare to the conductor and told him that she wanted to go to the Mavy Yard, and he gave her a. transfer.
