OPINION AND ORDER
LATCHUM, Chief Judge.
On June 28, 1973 plaintiff filed suit in this court against the named defendants to contest his dismissal from his post of County Administrator of Sussex County pursuant to a resolution passed on February 13, 1973 which terminated his services immediately and directed that his salary be paid to March 1, 1973. Alleging jurisdiction under 28 U.S.C. § 1343(3) and (4), as implemented by 42 U.S.C. § 1983, plaintiff claimed that his dismissal was in violation of (1) his rights to substantive due process, (2) procedural due process, (3) First Amendment rights,…
