Plaintiff seeks a judgment enjoining the defendant by means pictures scenes or of a play or dramatization, known as the Fechter version of the “Count of Monte Cristo,” and for an accounting. In or about the year 1844 Alexander Dumas wrote the novel “Count of Monte Cristo,” which was published by him in France and in this country, in two volumes consisting of about 600 printed pages in each volume, having about 701 characters, with a wealth of romantic scenes and incidents.
