Appeal by the defendant from a judgment of the Supreme Court, Kings County (Gerges, J.), rendered May 2, 2006, convicting him of murder in the second degree, manslaughter in the second degree, and assault in the first degree (three counts), upon a jury verdict, and imposing sentence.

Ordered that the judgment is modified, on the law, by vacating the conviction of manslaughter in the second degree, vacating the sentence imposed thereon, and dismissing that count of the indictment; as so modified, the judgment is affirmed.
