MEMORANDUM

CAHN, District Judge.

In this proceeding filed on June 16, 1971, plaintiffs 1 seek a determination that the Military Selective Service Act, 50 U.S.C. App. § 451 et seq. (hereinafter the Act), is unconstitutional. The defendants are the National Director of Selective Service, the Acting State Director of Selective Service for Pennsylvania, and Local Board No. 138 in Philadelphia, Pennsylvania.
