This case arises out of a business relationship between L. M. York and John Marshall. Marshall was in the business of selling antique furniture. York refinished furniture and entered into an arrangement wherein he would refinish furniture for Marshall. As a side issue York had Marshall to accept a piece of furniture on consignment to sell it for him. The item of furniture was lost, and the parties had a dispute with reference to this item of lost furniture. Whereupon, York advised Marshall to pick up all furniture that he was refinishing for Marshall. It appears that…
