This is an appeal by the defendant, Van Dyke Black and White Taxi Company, from an order of the City Court of Buffalo, directing the issuance of a commission at the instance of the plaintiff to take the deposition of the plaintiff as a material witness, residing at Brooklyn, N. Y., under section 2980 of the Code of Civil Procedure. The appellant bases its contention on the provision of section 56 of the act establishing the City Court of Buffalo, being chapter 570 of the Laws of 1909, as amended by chapter 188 of the Laws of 1915, which reads as follows: “ The *115provisions of the code of civil…
