The plaintiff, Jones, commenced this action in the superior court for King county, seeking an injunction against the defendant, Berg, restraining him from constructing a dwelling-house upon his lot in Seattle within eight feet of the north line thereof, which is also the south line of Jones’ lot. The claimed right to injunctive relief is rested upon a building restriction covenant contained in a deed executed by one *71Peterson to Jones while Peterson and one Christian-son were the owners each of an undivided one-half interest in Berg’s lot; and also upon the claimed authorization and…
