Lonnie McCain (“Movant”) was convicted by a jury of (1) assault of a law enforcement officer in the first degree, pursuant to section 565.081; 1 (2) misdemeanor driving while intoxicated (DWI), pursuant to section 577.010; and (3) misdemeanor driving while license was revoked (DWR), pursuant to section 302.821. His direct appeal was dismissed by this Court, pursuant to Rule 30.14, for failure to perfect the appeal.
