On October 29, 1908, the board of county commissioners of King county entered into the following contract with the appellant:
“This agreement made and entered into this 29th day of October, 1908, between King county, in the state of Washington, by and through its board of county commissioners, party of the first part, and H. H. Eaton, party of the second part;
