HOWARD, Judge.

We have consolidated for the purposes of appeal two criminal actions involving the same defendants. In 1966, a multicount indictment was returned against the appellees and others, charging them with various crimes including theft by false pretenses, embezzlement and perjury. These charges arose from the collapse of the Union Title Company. This indictment was quashed by the trial court on the ground that the presentation of the evidence before the grand jury was done by a disqualified deputy county attorney.
