Appeal by the plaintiff, Jennie C. AVilder, from a judgment of the Supreme Court in favor of the defendant, entered in the office of the clerk of the county of Kings on the 8tli day of June, 1895, upon the verdict of a jury rendered after a trial at the Kings County Circuit, and also from an order entered in said clerk’s office on the 17th day of June, 1895, denying the plaintiff’s motion for a new trial made upon the minutes.

Bradley, J.:
The plaintiff, in June, 1894, having entered one of the defendant’s Broadway cable cars at Forty-fourth street in the city of New York, as a.passenger, was thrown from her seat on to the floor of the car when it was on the curve of the railway at or about Fifteenth street. She charges that this accident was occasioned solely by the negligence of the defendant, and seeks to recover damages for the injury alleged to have been suffered by her in consequence of it.
