I. FACTUAL BACKGROUND

Plaintiffs Travis Bairn (“plaintiff’) and Donna Baim brought suit against defendants Philip Notto, Edward J. Ritz, E.C. Barbagelata, Steven Manikas, Mark Van-Cort, Thomas Ciampolillo, Kenny Figueroa, Patrick Horan, Erik Gandrow, and Christopher Macher, alleging: 1) illegal entry into the residence of plaintiff in violation of his Fourth Amendment rights; and 2) unlawful excessive force, both at plaintiffs apartment and at the Schenectady Public Safety Building.
