Certiorari to review a determination of the industrial commission denying employee’s petition to set aside an award and for a new hearing.

Employee’s petition was based upon the claim that as a result of an accident on August 22, 1941, he had become permanently and totally disabled because of a recurrent degenerated disc; that on November 20,1942, surgery had been undertaken at the Mayo Clinic to correct this condition but without success; that he could not submit to further surgery without an unreasonable risk to his life *371because of a heart condition and cerebral…
