FINDINGS OF FACT AND CONCLUSIONS OF LAW
MOTLEY, Chief Judge.
This action is before the court upon defendant’s motion to dismiss for lack of per: sonal jurisdiction pursuant to Federal Rule of Civil Procedure 12(b)(2). Plaintiff contends that this court has personal jurisdiction over defendant pursuant to Federal Rule of Appellate Procedure 4(a)(1) and New York Civil Practice Law sections 301 and 302(a)(1).
