Plaintiff, M. W. Plummer, Sr., brought suit in the county court of San Jacinto County June 20, 1961, against Ollie Durden, individually, and against C. H. Durden, individually and as independent executor of the estate of A. U. Durden, deceased. Ollie Durden was the surviving wife of said deceased. The suit was brought to recover the sum of $430.00 for legal services performed by plaintiff in the probating of said deceased’s last will and other services ancillary thereto. It was alleged that C.
