Appellee, Charles Forres, sued appeliants, Louis, Joe and Emily Veselka, to recover $1,000' as liquidated damages alleged to be due as the result of a breach of a written contract whereby appellants agreed to sell and to convey to him, on and about January 1, 1924, by “warranty deed with clear title,” the 112 acres of land described in the contract. Appellee attached and made the contract a part of his pleading, alleging that he stood ready, willing, and able to receive “warranty deed with clear title," and to pay the consideration and carry out his part of the contract on or about January…
