Count One of the petition in this suit is an action to ascertain and determine title to forty acres of'land in Pemiscot County. Plaintiffs are the heirs of J. M. Big-ham who died about 1907. Defendants, except for the administrator and a tenant who were included as more or less nominal parties, are the heirs of Stephen S. Pate; he derived whatever interest he may have had by will from his wife, Mary Agnes Swin-ney' Pate, a daughter of Bigham.
