Plaintiff appeals from a summary judgment granted by the district court of Blaine County in favor of defendant.

In February 1973 defendant Orin R. Cure, as executor of the estate of Chris G. Mayer, deceased, filed a return of sale and a motion for an order confirming sale of real estate made under a power of sale contained in the will of Chris G. Mayer.
