The hypothesis upon which appellee recovered judgment against appellant in the circuit court may be stated thus:

Sutherland, owning a tract of land, negotiated with Ludeke for the sale of the land to Ludeke. The land ivas supposed to contain about 140 acres, and a sale was verbally agreed upon between the parties, about October 24, 1874, at the agreed price of $27 per acre; and the parties agreed further that Sutherland would at once convey the land to Ludeke, and that Ludeke would, at the delivery of the deed, pay to Sutherland $500, and at the same time execute to Sutherland his promissory…
