This appeal explores the tension between public and private systems for recording real property interests in Texas. Plaintiffs-Appellants — Dallas, Harris, and Brazoria Counties (collectively, “the Counties”) — filed this lawsuit against MERSCORP, Inc., Mortgage Electronic Registration Systems, Inc. (“MERS”), and Bank of America, N.A. (sometimes collectively, “Defendants”).
