*219This is a negligence action to recover for personal injuries that plaintiff suffered on August 24, 2004. Plaintiff alleges that during the course of his employment as a concession vendor at Shea Stadium, he was caused to fall when he was struck by a fan who was diving for a shirt that was launched into the stands by the defendant. The t-shirt launch was a promotional activity that occurred between innings and is common at many sporting events.
