Appeal from a judgment of the Supreme Court, Erie County (Russell E Buscaglia, A.J.), rendered October 28, 2009. The *1810judgment convicted defendant, upon a jury verdict, of robbery in the third degree.

It is hereby ordered that the judgment so appealed from is unanimously affirmed.
