WISDOM, Circuit Judge:
On May 14, 1970, the plaintiff, Harold Letcher,1 a retail liquor-store owner in Brownwood, Texas, brought this action under the Sherman AntiTrust Act of 1890, §§ 1 and 2,2 against the Adolph Coors Company. Letcher contended that Coleman Distributing Company, a Coors distributor, had refused to deliver Coors beer to him. At trial Letcher abandoned the claim under section two of the Sherman Act, and the court submitted the case to the jury only under section one.
