Z. M. Ford is an architect and contractor residing in Somerset, Ky. A. Gr. Colyer, also a resident of that city, ordered some ornamental building tile from Ford to be used in a garage building Colyer was constructing in Somerset. The tile cracked and fell from the building within a few months after it was put on, and Colyer filed this action against the Wheeling Tile Company, a corporation of West Virginia, alleging that the tile was defective and that Ford is its agent, and was acting as such when he sold plaintiff the tile manufactured by…
