Appellant Jacques Berenguer, also known as Guy Sebbane, was convicted in a jury trial of conspiring to possess Schedules I and II narcotic drug controlled substances with intent to distribute in violation of 21 U.S.C. §§ 812, 841(a)(1), 841(b)(1)(A) and 846, and of aiding and abetting the distribution of cocaine, in violation of 21 U.S.C. §§ 812, 841(a)(1) and 841(b)(1)(B). In this appeal he does not challenge the sufficiency of the evidence, but contends that he was prejudiced by (1) the admission of evidence of an independent conspiracy in which he was neither…
