MEMORANDUM AND ORDER

CROW, District Judge.

The case comes before the court on the defendants’ motions to dismiss on jurisdictional grounds. Defendant Karl L. Barth moves the court to dismiss all claims against him for the reason that this court lacks personal jurisdiction over him. All defendants move to dismiss Counts I and III of plaintiff’s complaint for lack of sub ject matter jurisdiction of this court. The court will first consider defendant Barth’s motion.
