Affirming.

*203The appellant, C. T. Bondurant, having- contracted to perform certain constructive levee work in the Reel Foot district in Fulton county, this state, sublet a part of the work to one Ben Tally who owned an outfit consisting- of mules, implements and machinery required for doing-such work.
