This is an action of covenant, brought by the plaintiff below, (William Lecky,) against the Commis*167sioners of Allegheny County, to recover a sum of money agreed to be paid by the defendants, for a .lot of ground in the city of Pittsburgh. The agreement was under the public seal of the commissioners, and signed by two of them. The third commissioner did not assent to the agreement, and therefore did not sign it.
