Because I believe that the majority errs in reversing and remanding this case and overlooks this court’s prior case law, I respectfully dissent. While the majority opinion states that it is unnecessary to address appellant’s second point on appeal, the two points are so interrelated that I think they must be addressed together, and I do so in this dissent.
