This is an action in tort for wrongful death, appealed here on questions of law from a judgment of the Court of Common Pleas of CuyahogaCounty, rendered on a verdict in favor of plaintiff in the sum of $75,000.

The accident occurred on December 9, 1949, on the premises of The National Tube Company at Lorain, Ohio. It was due to the sudden collapse of a boom section attached to a 20-ton moto-erane, the property of defendant (herein called Gardner), which, in falling, struck plaintiff’s decedent on the head, causing instant death.
