This matter came before the court for oral argument on December 11, 1992 pursuant to plaintiffs motion for summary judgment, wherein the plaintiff claims that it is entitled to payment of $19,416 from defendant due to the fact that plaintiff had to pay out on a surety bond covering a project being constructed with funds administered by defendant. The court took the matter under advisement, and after having considered the oral argument, memoranda, and affidavits submitted by the parties, the court hereby renders the following decision.
