On April 30, 1962, after a jury trial, appellant was found guilty of burglary, arson, armed robbery and murder in the first degree. The jury fixed the penalty for murder at death. On June 17, 1964, a new trial was granted appellant for reasons not relevant to our determination of the instant appeal.
