With the parties’ submissions and this Court’s August 28, 1995 approval of the final pretrial order (“FPTO”) having established the ground rules for the trial of this action, brought by Lazara Opio (“Opio”) as Adminis-tratrix of the Estate of her deceased husband Edilberto Opio Diaz (“Diaz”) against truck driver Michael Wurr (“Wurr”) and truck owner Newell Trucking, Inc.
