Appellant, Roger Sefzik, sued the appel-lee, the Texas Department of Transportation (TxDot), seeking a declaration that the Texas Administrative Procedure Act’s provisions governing “contested cases” apply to TxDot’s denial of an application for a permit to erect an outdoor-advertising sign. Sefzik also sought damages for constitutional due process violations. TxDot filed a plea to the jurisdiction, asserting that sovereign immunity barred Sefzik’s claims.
