Noah H. Driggers was struck by a train of the Southern Railway Company on Hampton Street, Columbia, S. C., on the 21st day of July, 1929, receiving injuries from which he died some hours afterward. This action was brought by the executrix for the benefit of herself and the three children of the testator, pursuant to the provisions of Sections 366, 367, and 368 of the Code of Civil Procedure of 1922 (Eord Campbell’s Act), against the Southern Railway Company, Southern Railway — Carolina Division, and…
