Appeal from chancery. The bill in this cause was filed against Samuel Jones, John L. Graham, and The Fanners’ Loan and Trust Company, to foreclose a mortgage bearing date the 4th day of April, 1835, executed by Jones and Graham to John Walworth, as clerk in chancery for the first circuit. The Farmers’ Loan and Trust Company defended the bill, and the case, upon pleadings and proofs, was in substance as follows.
