Appeal by the defendant, John T. Williams, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of 27ew York on the 21st day of December, 1901, upon the decision of the court rendered after a trial at the 27ew York Special Term, and also from an order entered in said clerk’s office on the 20th day of May, 1902, denying the defendant’s motion for a new trial.

This action was brought to foreclose a mechanic’s lien which had been filed against certain premises at the northeast corner of Beach and West streets for a balance due upon a contract entered into between the plaintiff and the defendant, who was the owner of said premises, whereby the plaintiff contracted with the defendant to well and sufficiently execute, deliver, erect and finish in a true, perfect and thoroughly workmanlike manner to the satisfaction and under the direction and supervision of the defendant all the carpentry work (with certain exceptions therein…
