This is an appeal from a judgment in favor of the appellee, on a verdict rendered for him in accordance with a prayer that the plaintiffs had offered no evidence legally sufficient under the pleadings to entitle them to recover and that the verdict must be for the defendant. The case was tried before the Court without the intervention of a jury and that prayer Avas granted at the conclusion of the, plaintiff’s evidence.
