OPINION OF THE COURT

Memorandum.

The order of the Appellate Division should be affirmed, without costs, and the certified question not answered as unnecessary.

Defendant was paroled on July 27, 1988. On October 21, 1988, he was stopped by New York City police officers who recovered a gun from him. Defendant was arrested and charged with criminal possession of a weapon, second degree, but the criminal charges were subsequently dismissed.
