SENIOR JUSTICE WHITING delivered the opinion of the Court.

In this appeal, the primary issue is whether a newspaper publishing company had a duty to warn a 13 or 14-year-old independent contractor of the danger of a criminal assault by a third party while *219delivering newspapers in early morning hours.1 Because the trial court sustained the company’s motion to strike the evidence, we state the facts in the light most favorable to the plaintiff. See Tarmac Mid-Atlantic, Inc. v. Smiley Block Co., 250 Va. 161, 163, 458 S.E.2d 462, 464 (1995).
